Terms of Service

Effective date: August 2, 2026

These Terms of Service ("Terms") govern your access to and use of Bookmarx, the bookmark organization service available at bookmarx.co (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Bookmarx does

Bookmarx connects to your X (Twitter) account with read-only access, imports the posts you have bookmarked, and helps you organize and understand them. Features include AI-generated summaries, tags, and collections, periodic email digests, visual deck generation, search, and an AI assistant that answers questions about your saved content.

2. Eligibility and accounts

  • You must be at least 13 years old to use the Service, and at least 18 (or the age of majority where you live) to purchase a paid plan.
  • You sign in with a Google account and may connect one X account. You are responsible for the security of those accounts.
  • An X account can be linked to only one Bookmarx account at a time.
  • You must provide accurate information and keep it up to date.

3. Your content and licenses

Your bookmarks and the posts they reference belong to their original authors and are governed by X's terms. You retain all rights you have in content you save or create in the Service. You grant us a limited, non-exclusive license to host, process, and display that content solely to operate and improve the Service for you, for example to generate summaries, tags, digests, and decks. This license ends when the content or your account is deleted, except where retention is required by law.

4. AI-generated content

Summaries, tags, insights, personas, decks, and assistant responses are generated by artificial intelligence and may be inaccurate, incomplete, or misleading. They are provided for personal informational use only and are not professional, financial, legal, or medical advice. You are responsible for verifying anything you rely on.

5. Plans, credits, and billing

  • Free plan. Includes one-time allowances (for example bookmark syncs and deck credits) that may be subject to an expiry window and promotional rewards.
  • Paid subscriptions. Billed in advance on a recurring basis through our payment provider, Dodo Payments. Your plan renews automatically until cancelled.
  • Plan credits reset to your plan's allowance each billing cycle and do not roll over. Add-on credit packs are one-time purchases that do not expire and are consumed after plan credits.
  • Cancellation. You can cancel anytime from Settings. You keep paid access until the end of the period you already paid for; after that your account moves to the free plan. Your data is not deleted on cancellation.
  • Failed payments. If a renewal charge fails we will retry it. While payment is outstanding, plan benefits may be paused.
  • Refunds. Except where required by law, payments are non-refundable. If you believe you were charged in error, contact us at support@bookmarx.co and we will review it.
  • Prices and plan allowances may change; changes apply from your next billing cycle after reasonable notice.

6. Acceptable use

You agree not to:

  • use the Service for anything unlawful or infringing;
  • probe, scrape, overload, or disrupt the Service, or access it by automated means other than the interfaces we provide;
  • reverse engineer, resell, or white-label the Service;
  • circumvent usage limits, credits, or billing;
  • use the Service to violate X's or Google's terms; or
  • upload malicious code or interfere with other users.

7. Third-party services

The Service depends on third parties, including X (bookmark data), Google (sign-in), OpenAI (AI processing), and Dodo Payments (billing). Their availability is outside our control, and their terms apply to your use of their services. If X revokes or limits API access, parts of the Service may stop working; we are not liable for such third-party changes.

8. Our intellectual property

The Service, including its software, design, and branding, is owned by Bookmarx and its licensors. These Terms do not grant you any rights to it except the limited right to use the Service as intended.

9. Termination

You may stop using the Service and request account deletion at any time by contacting support@bookmarx.co. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service, in which case we will give reasonable notice where practicable.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that synced content will always be complete.

11. Limitation of liability

To the maximum extent permitted by law, Bookmarx will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for all claims relating to the Service is limited to the amount you paid us in the 12 months before the claim arose, or USD 50 if you have not paid us anything. Nothing in these Terms limits liability that cannot be limited by law.

12. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will notify you by email or in the app before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of India, and courts located in Mumbai, Maharashtra have exclusive jurisdiction over disputes arising from them, except where the law of your country of residence grants you mandatory protections and venue.
